Terms of Service

These Terms of Service ("Terms") govern your access to and use of SiteUnload (the "Platform"), operated as an online marketplace for surplus, reclaimed, and leftover construction materials. By creating an account, listing materials, or transacting on the Platform, you agree to these Terms.

1. Eligibility & Identity Verification

You must be at least 18 years old and legally able to enter binding contracts to use SiteUnload. All sellers must complete identity verification by submitting a photo ID through the Platform. Approved sellers receive a "Verified Seller" badge. SiteUnload may reject or revoke verification at its discretion.

2. Your Account

• You are responsible for keeping your password and account secure.
• You may not transfer or sell your account.
• You must provide accurate information and keep it current.
• You are responsible for all activity under your account and must notify us of any unauthorized use.

3. SiteUnload's Role

SiteUnload provides a marketplace and escrow facilitation service. SiteUnload is not a party to any transaction between buyers and sellers, does not take title to any material, and does not inspect, store, or ship materials. Transactions are between users; SiteUnload's role is limited to providing the Platform, holding escrow funds via Stripe, and facilitating communication.

4. Fees

• Cash sales: SiteUnload charges a platform fee of 8.5% of the sale price. The seller receives 91.5% of the sale price, paid out via Stripe Connect.
• Barter swaps: Each party to a swap pays a $7.50 flat swap fee.
• Payment processing: Stripe's standard processing fees apply to card payments and are disclosed at checkout.

Fees are deducted automatically. By listing or buying, you authorize SiteUnload and Stripe to calculate and retain fees as described.

5. Listing Materials

• Sellers may list only materials they own or are authorized to sell, and that are legally transferable.
• Listings must be accurate and include honest descriptions and representative photos, consistent with our As-Is & Disclosures page.
• Prohibited listings include hazardous or illegal materials, recalled products, counterfeit goods, and any item requiring a licensed professional to transfer. SiteUnload may remove any listing at any time.
• Sellers may use the bulk upload tool, but are responsible for the accuracy of every row submitted.

6. Transactions & Escrow

Cash purchases and swaps are protected by escrow held through Stripe Connect. Buyers fund escrow before pickup; funds are released to the seller only after the buyer confirms the exchange. Token verification may be used to confirm in-person exchange. Full details are in our Escrow Policy.

7. Messaging & Anti-Circumvention

To protect users and the Platform, messages between buyers and sellers are filtered for attempts to share contact information, payment links, or other content intended to take transactions off-Platform and avoid escrow and fees. Attempting to circumvent the Platform's payment systems may result in suspension and forfeiture of escrow protection.

8. Prohibited Conduct

You agree not to:

• Post fraudulent, misleading, or illegal listings;
• Attempt to complete transactions outside the Platform to avoid fees or escrow;
• Harass other users or misuse the messaging system;
• Use bots, scrapers, or automated tools to access the Platform;
• Reverse engineer or disrupt the Platform's infrastructure.

9. Dispute Resolution

Users should first attempt to resolve disputes in good faith through in-app messaging. Escrow disputes are handled under the Escrow Policy. For disputes that cannot be resolved, you and SiteUnload agree to resolve claims through binding individual arbitration rather than court proceedings, except that either party may bring small-claims court claims. These Terms are governed by the laws of the jurisdiction in which SiteUnload operates, without regard to conflict-of-law principles.

10. Indemnification

You agree to indemnify and hold harmless SiteUnload and its operators from any claims, damages, or expenses arising out of your listings, transactions, communications, or violation of these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, SiteUnload and its operators shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from transactions between users. Our aggregate liability for any claim is limited to the fees you paid to SiteUnload for the related transaction.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on the Platform with an updated date. Continued use after changes takes effect constitutes acceptance of the revised Terms.
